The state has given the executive branch a set of powers to manage affairs of state importance. The activities of structural organizations are aimed at organizing the implementation of the Constitution of the Russian Federation and legal acts of the state. Regional sectoral bodies include the Moscow Department of Education. It operates in the field of education and controls the functions of school, preschool, vocational and higher education institutions. As soon as a controversial or conflict situation arises with the management of any educational institution, a complaint or petition is submitted to the department.

Authority's powers

Complaint to the Ministry of Education

Every person at least once in his life has become involved in a conflict with a school teacher, a school director, or with the entire management of an educational institution. Usually there are two opinions on this matter, one of which is always polarly different from the other:

  1. The student “sits on the neck” of the teachers and is the undisputed culprit of the incident.
  2. The culprit is a teacher who takes advantage of his official position and does not value his students at all.

If you do not want your children to become a victim of misconduct on the part of the school, you should be able to write a complaint to the appropriate authorities, following the format and filing rules.

Among the conflict situations, there are those that require writing a complaint:

  1. A conflict unresolved at the primary level with the leadership of a school, kindergarten or other organization.
  2. Incompetence of an employee of an educational institution. This could be a teacher, a psychologist, or a manager.
  3. Biased attitude towards the student.
  4. Violence of any level - moral, physical.
  5. Difficulties with registration in an educational institution.
  6. Injury to a child due to poor supervision.

  8. Assessment of knowledge in an unfair format.

Often the nature of the complaint can be quite serious. However, violations in the preparation of the document lead to the fact that it does not reach the consideration of the Moscow Department and is returned to the applicant without a resolution. Common mistakes that citizens make:

  • information about the applicant is missing completely or partially;
  • illegibility of the text does not allow the document to be properly read;
  • the text of the complaint contains too emotional, obscene or rude expressions;
  • if there is already a court decision on this issue;

Consequences of filing

If the student’s rights and freedoms are not respected, his parents or he himself can begin to take measures to protect them. This process is regulated by Art. 45 of Federal Law No. 273-FZ.

For teachers

Unlawful actions of a teacher or other employee of a general education institution can be appealed as follows:

  • appeal to the violator’s immediate superior (school director);
  • submitting the dispute to the commission for consideration.

A complaint addressed to the director must be made in writing. When writing it, be sure to indicate:

  2. School number and location.
  3. Subject of the complaint (brief description of the incident, full names of the teacher and student, information about possible witnesses).
  4. The essence of the request.
  5. Full name of the applicant.
  6. Date of.

Resolution of a controversial situation is also possible by submitting an application from the student or his legal representative (parent, guardian) to create a specialized commission.

The members of the commission are representatives of students' parents and school staff. They are selected by the parent committee and the competent authority of the educational organization.

Conflicting parties have the right to be present at the consideration of the application. Also, as necessary, witnesses and other persons who can clarify the issue under discussion are called to the meeting. Based on their testimony, legislative acts and regulations of the institution, as well as the results of a comprehensive analysis of the current situation, a decision is made. Its content is mandatory for all parties to the dispute, but it can also be appealed in court.

If the outcome is unsatisfactory for the victim or there is no response from management, the claim is submitted to higher authorities. In this case, both the teacher’s original offense and the director’s inaction are subject to appeal.

You can send a letter to the district office by mail or email. Municipal authorities also have their own official portals, and some of them have electronic reception desks that provide convenient submission of applications for consideration by competent specialists.

To school

The process of appealing a general education institution is similar to the same procedure addressed to the director. To do this, the applicant also needs to submit a letter to the municipal administration, and in the application itself enter the address and school number, describe the offense and a list of violators with full name and information about their positions.

  3. Revocation of the license of a private educational organization.
  4. The appointment and application of disciplinary or administrative measures, and sometimes criminal punishment to the perpetrator.
