Sick leave: features you need to know

Every employee knows that quitting work in order to recover and get over an illness easier is not something you can do, even if your boss is a truly kind soul.

The boss does not have the right to release you from work for a long period, even if you are ill.

Labor legislation prescribes in such situations to go to a public medical institution - a clinic to which you belong at your place of residence, or any other to which you want to attach. There you are assigned a general practitioner who prescribes treatment for you and gives you sick leave, opening it for a certain period. Provided that you still require treatment and rest, the certificate of incapacity for work can be extended.

The form of this document is officially approved by government agencies. So, according to the original idea, the required sheet has two categories of graphs:

  • intended to be filled out by a representative of a medical organization;
  • intended for completion by employees of the employing organization.

It is understood that the required form can be filled out either manually or using printing devices. Provided that you decide to fill out the form manually, you must comply with certain requirements. For example, filling can only be done with a black gel or ink-based pen . Ballpoint writing utensils are prohibited.

Entering information into the columns of the documents we are interested in is carried out:

  • in the official dialect of our country - Russian;
  • using capital letters and not using italics;
  • strictly inside each cell;
  • entering characters strictly from the first cell of each row.


Filling out a sick leave certificate can only be done taking into account various rules.
Provided that these or some other conditions for filling out the form are not taken into account, and as a result of this, certain errors are made when filling out, the document is considered invalid . In this case, the sick citizen is given a different document.

Which organizations have the right to issue certificates of incapacity for work?

The registration and issuance of certificates of incapacity for work are strictly regulated by the legislation of the Russian Federation, namely:

  • Federal Law No. 255-FZ of December 29, 2006 “On compulsory insurance in case of temporary disability and in connection with maternity”;
  • Order of the Social Insurance Fund of the Russian Federation and the Ministry of Health of the Russian Federation dated January 29, 2004 No. 18/29 “On approval of the Instructions on the procedure for providing sick leave certificates with forms, their recording and storage”;
  • Order of the Ministry of Health and Social Development of Russia dated June 29, 2011 No. 624n “On approval of the procedure for issuing certificates of incapacity for work.”

A certificate of temporary incapacity for work is issued to the insured persons:

  • citizens of the Russian Federation;
  • foreigners or stateless persons permanently or temporarily residing on the territory of the Russian Federation (Article 2 of Federal Law No. 255-FZ of December 29, 2016).

Sick leave is issued by medical workers who have the right to do so, namely:

  • attending physicians of medical organizations;
  • paramedics and dentists of medical organizations;
  • attending physicians at research institute clinics, including clinics at research institutes of prosthetics or prosthetics.

New rules for issuing sick leave in 2021

The Ministry of Health issued order No. 925n dated September 1, 2020 “On approval of the procedure for issuing and processing certificates of incapacity for work, including the procedure for generating certificates of incapacity for work in the form of an electronic document.” Document No. 59812 was registered with the Ministry of Justice on September 14, 2020 and officially published. It came into force on December 14, 2020. The changes are aimed at simplifying the issuance of sick leave in the face of the threat of the spread of dangerous diseases, especially coronavirus infection. Medical institutions were allowed to issue sick leave certificates remotely, after the patient contacted a therapist via chat or video call, that is, using telemedicine technologies. Similarly, if necessary, a certificate of long-term incapacity for work for pregnancy and childbirth is filled out.

A medical institution’s sick leave certificate was required to be issued in the form of an electronic file and only duplicated on paper if necessary. In the future, the Ministry of Labor plans to completely abandon paper sick leave. For now, as an exception, they will be issued:

  • pregnant women who were dismissed due to the liquidation of an enterprise, who lost their individual entrepreneur status or resigned as a notary (lawyer);
  • unemployed citizens who need to confirm that they did not come to the employment service on the appointed day for a good reason.

Parents of preschool children attending kindergarten are given sick leave immediately for the entire quarantine period if it is declared in kindergarten.

Conditions for calculation on sick leave

— for version 1.0.7 of the “Workstation Policyholder” program, in the “Recipient” field, you must select the “Applicant” position if the recipient is the applicant himself (the employee to whom the LN was issued). The position “Authorized representative” is selected only if the recipient of the benefit is not the applicant himself, but his authorized representative. In this case, it is necessary to fill in all the fields provided for completion by an authorized representative (full name, type, series, number, date of issue of the document, and by whom the document was issued). If this position is not filled out correctly, the sick leave will not be accepted for calculation.

7. To pay benefits when registering in the early stages of pregnancy, when filling out the Maternity and Childbirth benefit, check the box “Registered in the early stages of pregnancy (up to 12 weeks).” This type of benefit cannot be selected separately. Thus, registration of sick leave in 2021, just like several years before, is completed on a specialized form of the established form . It has a blue tint and is a printed form received by all medical institutions from territorial social insurance funds.

Each such form has a twelve-digit number.


At what points on the form is the sick leave number located?

This paper is divided into three sections. Two of them are detachable. Each is filled out by a specific official:

  • the doctor enters the first and third information;
  • in the second, the employer provides information.

The document number is located directly in the upper right corner of one of the blocks designated for completion by the treating organization. It is also duplicated on the right side in the corner of the tear-off block, directly below the segment separation line.

Common mistakes

Error:

If I work two jobs at once and am officially registered as a part-time worker, I cannot ask the hospital for two sick leave documents at once.

How to check sick leave through a medical institution

You can also check the authenticity of the sick leave through the medical institution that is indicated on it. The employer can send a written request there in any form. Medical organizations have no obligation to respond to such requests, but, as a rule, they meet them halfway.

In this case, the employee must consent to receiving his personal data from a third party. By law, employee personal data must be obtained from them themselves or written consent to obtain it from third parties must be requested. In some cases, an employer may receive personal data without the employee’s consent, but requesting information about sick leave at a medical institution does not apply to this.

Where is the series and number of the sick leave certificate indicated?

As can be seen from the structure of the document, the sick leave certificate now contains only a unique number of 12 digits. The series was in the previous version of the temporary disability certificate, which was used from 2007 to 2012.

The sick leave number is located at the top of the document under the barcode. This allows the federal fund or commission to check its authenticity in a special database and find information about payments for a specific insured event.

There is also a similar field with a barcode and number in the section of the sick leave certificate filled out by the employer.

Important! This information is much more important for maintaining a document in electronic form. The patient does not receive a sick leave certificate from the doctor, but only his number. This is what needs to be reported to the accounting department of the employing company. This allows you to find the document in the specialized Social Insurance system and fill out its second part. Then the completed form is sent to the federal fund for verification. After approval, a company employee can receive his payments in a convenient way.

If the patient was treated on an outpatient basis, the document is issued on the day of treatment. The issuance and extension of sick leave for the past is carried out in exceptional cases provided for by current legislation. Sick leave, which was issued to care for a sick relative, does not provide for issuance for the past period.

Payment of sick leave

As you know, every officially working citizen, according to the regulatory legal acts of our country, must have social insurance type. As a result, if you suddenly get sick, or due to other circumstances temporarily lose the ability to work, and receive a special blue form from the clinic, you apply for monetary compensation and a certain number of days of non-attendance at the workplace.

To receive benefits, you need to present a slip issued by your attending physician at work, and then you will receive payments on your salary card for the entire time period during which you will not be able to work.

Sick leave is covered by benefits

If, at the time of receiving sick leave, your employing organization has completed its activities, you can apply with a sick leave certificate to the Social Insurance Fund. 10 after the application, the benefit will also be transferred to your account.

Payment of funds in the category we are interested in will be made immediately for the entire period indicated on the sick leave certificate. The amount of the required payment is directly dependent on your work experience and the average employee’s earnings calculated over the last 2 years. Thus:

  • if your length of service is equal to a value not exceeding six months, then the amount of the benefit will be equal to the current minimum wage;
  • if the length of service is more than six months and less than 5 years, then the amount of payment will be equal to 60% of your salary;
  • if you worked for at least 5 and no more than 8 years in total, then you are entitled to 80% of your average earnings on sick leave;
  • for everyone who has been working for more than 8 years, the amount of the benefit will be the entire amount of average earnings.

The main differences between the new form and the old one

The main purpose of the new sick leave form is to increase the level of document security. The higher the level of protection, the more difficult it is to forge a certificate of incapacity for work, which significantly reduces the risk of fraud by third parties. In addition, the new sick leave contains instructions on how to fill it out, which minimizes the risk of the document being filled out incorrectly by the medical professional and the employer. The main differences of the new type of sick leave certificate include:

  • The presence of new, more complex watermarks in the form of the Social Security Fund logo, which are more difficult to fake;
  • The information on the form can be read by a computer, so it can only be filled out in large block letters;
  • Information about the disease (cause of disability) is encrypted with a special code;
  • Introduced new fields to be filled in by the employer;
  • The presence of a barcode that confirms that the form was actually printed by the Social Insurance Fund;
  • The presence of a QR code (two-dimensional code) with which you can encrypt all information from the sick leave certificate;
  • All basic information is filled out only on the front side.

In addition, the color of the sick leave certificate has changed. Previously it was completely green, now it is yellow-green lines on a blue background (see Figure 1). Another fundamental difference of the new certificate of incapacity for work is corrections. Previously, an unlimited number of corrections were allowed, both on the part of the health worker and on the part of the employer. Now in the “To be filled out by the employer” field no more than 2 corrections are allowed; in the “To be filled out by a medical professional” field no corrections are allowed at all (if there are errors, the patient must be provided with a new certificate of incapacity for work). The employer corrects his mistakes by crossing out the incorrect information and making a corresponding entry on the reverse side of the sheet.

The old-style sick leave necessarily contained the series and number of the document. The new sample hospital note does not have the series, but the number remains. It is duplicated 2 times under the barcode in the field “To be filled out by a doctor of a medical organization” and in the field “To be filled out by a doctor and remains in a medical organization.” In Figure 1 this number is “001 234 567 891”. The same number is encrypted in the barcode itself, which greatly complicates the procedure for falsifying a document.

How to fill it out correctly: step-by-step instructions

What information does the doctor enter?

First section: certificate of incapacity for work

  1. The number of the certificate of incapacity for work, consisting of 12 digits, which is assigned by the FSS through its website.
  2. LNE type. There can be three options here: primary BL, duplicate, continuation of BL. The continuation of the certificate of incapacity for work can only be indicated if there are previous sick leaves.
  3. Name of the medical institution, its address and OGRN. Typically, this data is already entered into the program and the doctor only needs to select the necessary information.
  4. Date of issue of ELN. Date format – day, month, year.
  5. Separate lines indicate the patient's last name, first name and patronymic, as well as the date of birth and gender of the benefit recipient.
  6. Cause of disability. This is a numeric code from 01 to 15 that is dropped from the list. For example, if the patient had ARVI, then the doctor puts code 01 in this line, indicating any disease.
  7. Additional code, which is also selected from the drop-down list. This line contains special notes about the place of treatment. For example, code 017 means that the patient was treated in a specialized sanatorium.
  8. Code of changes, if any, and date of change of the reason for issuing the electronic tax record. Read what code 020 means and other meanings here.
  9. Patient's place of work. Here you must indicate the name that the patient indicates. Typically, employers tell their employees how to spell the company name correctly to avoid mistakes. You can find out how to correct errors online here.

Second: release from work

  1. Two dates of release from work are indicated: on what date this period began and on what date it ended. Dates are entered in the format day, month, year. For example, 03/12/2018.
  2. Doctor's position. She is selected from a pre-entered list of positions for doctors in a given medical organization. For example, "therapist".
  3. Last name and initials of the doctor. This information is also entered from a drop-down list, which includes information about all doctors in a particular clinic. For example, “Voronova AN” (initials are indicated without dots).

Third: travel package, child care

  1. The first date is entered. For pregnant women - the expected date of birth. For vacationers on a voucher - the start date of the voucher. Date format – day, month, year.
  2. The second date is entered. Only the end date of the tour is indicated here.
  3. The ticket number is indicated.
  4. The OGRN of the sanatorium is indicated.
  5. The total number of years the patient was cared for is indicated.
  6. The age of the child under one year of age for whom care was provided is indicated.
  7. Next, select a relationship from the drop-down list. Two numbers are placed to indicate the family member who cared for the patient and received sick leave. This could be a mother, father, guardian, trustee, or other relative.
  8. The last name, first name and patronymic of the family member who was cared for is indicated.

Fourth: hospital, disability, violation of the regime

  1. For pregnant women, it is indicated at what time they were registered before 12 weeks (in the early stages) or after this time.
  2. If the patient violated the regimen, the doctor selects a violation code from the drop-down list. This may include non-compliance with the regime, leaving the hospital, late attendance for an appointment, going to work without being discharged, etc. The date on which the regime was violated is also indicated.
  3. The dates on which the patient was hospitalized are indicated.
  4. The dates of referral to the Bureau of Medical and Social Expertise (MSE), registration of documents and examination by the ISE are indicated.
  5. If the patient's disability group is assigned or changed, a mark is placed in the appropriate line.

What information does the employer provide?

How can an employer issue a certificate of incapacity for work through the Social Insurance Fund system? Using the ELN number, the personnel or accounting service finds the required sick leave in the FSS information system

and enters the necessary data. Below you can see an example of how to fill out the document.

  1. Name of company. It is recommended to include a short company name, if available. This is necessary so that it fits on the line. For example, instead of United Design Bureau LLC, it is better to write United Design Bureau LLC.
  2. Job status: main or part-time.
  3. Registration number of the company in the Social Insurance Fund. It consists of 10 digits and is assigned to each company after its registration.
  4. Territorial number of the Social Insurance Fund to which the organization reports. This number consists of four digits if it is a central body, or five if it is a regional branch of the fund.
  5. TIN and SNILS of the employee.
  6. Special conditions for calculating and paying benefits. Here you need to indicate the code if benefits are calculated differently than for the majority of Russian citizens. Special conditions are provided for residents of the Far North who are exposed to radiation, the disabled, employees who have been working for less than six months, employees who fell ill within a month after dismissal, and others. If several codes are suitable, then all of them are entered, but no more than three.
  7. If an employee is injured at work, then fill out the line “Act Form N-1”. The date of drawing up the act is entered here.
  8. Work start date. This line is filled in if the organization terminated the employment contract with the employee due to the fact that he did not show up for work on time.
  9. Insurance experience. This line includes the entire period during which the employee is insured and makes contributions to the Social Insurance Fund. Information is entered, for example, like this: 18 years 7 months.
  10. Non-insurance periods. Such periods include military service starting from January 1, 2007. This period is also included in the insurance period.
  11. The period for which benefits are calculated. The line indicates the calendar period during which the employee did not work. That is, the opening and closing dates of the electronic sick leave.
  12. Average salary. The employee’s earnings for the two previous years are taken as the basis. If the employee worked less than this period, then the minimum wage is taken as the basis.
  13. Average salary per day. The benefit is calculated for calendar days, so it is calculated how much the employee receives per day. To do this, the amount earned over two years is divided into 730 days.
  14. The amount of benefit paid by the employer. The employer pays for the first three days of sick leave from his own funds. If the reason for the disability is different, the entire amount is paid by the Social Insurance Fund.
  15. The amount of benefits paid by the Social Insurance Fund. Insurers fully pay for sick leave if it was issued for caring for a sick person, due to quarantine, for treatment in a sanatorium or for prosthetics.
  16. Total amount. It is calculated as follows: you need to multiply the number of days by the employee’s average daily earnings and percentages, which depend on his insurance record.
  17. Last name and initials of the head of the organization. Initials are indicated without dots.
  18. Last name and initials of the chief accountant. If there is no such position, then the previous line is duplicated a second time.

When all the cells are filled in, an electronic signature is placed and the form is sent for verification to the FSS.

Who else can apply for an ELN?

Electronic sick leave can also be filled out by doctors of sanatoriums and dispensaries

, as well as employees of the Bureau of Medical and Social Expertise. They fill out all sections of the sick leave certificate, including those related to information about treatment on a voucher (for sanatoriums and other medical organizations) and about passing a medical and social examination (for the ITU bureau).

If the patient is unemployed and is registered with the employment service, then the section intended for the employer is filled out by employees of the employment center to which the unemployed person is assigned.

Waybill series

The unified form of waybill for a passenger car is mandatory to be used by specialized and motor transport organizations. But “ordinary” organizations have the right to develop their own form of waybill (Letter of the Federal Tax Service of Russia dated November 14, 2006 No. 20-12/100253).
