Article 128 of the Labor Code of the Russian Federation. Leave without pay

In the life of almost every employee, sudden absence from work arises. In such a situation, a person can take a vacation at his own expense. The right to it is regulated by Article 128 of the Labor Code of the Russian Federation . From this norm it follows that such a vacation has the following characteristics:

  1. Provided without salary.
  2. Given based on the employee’s application.
  3. The employee must retain his job.
  4. The duration of the vacation is determined by agreement between the employer and employee.
  5. Since the salary is not maintained, the employer does not have to pay vacation pay for the period of such vacation.

Is it necessary to provide?

As a general rule, the employer provides the employee with leave at his own expense if there is a good reason. This could be a family circumstance or even just a desire to relax - the degree of validity of the stated reason is determined by the company itself (IP).

But there are certain situations when leave without pay is granted regardless of the employer’s wishes. These cases are collected in the following table.

Collective agreement

In a collective agreement, the parties can agree on the conditions under which unpaid leave is granted, for example:

  • employees who have more than two children under 14 years of age;
  • employees who are raising a disabled child under 18 years of age;
  • father or mother who is the sole parent of a child under 14 years of age.

Cases for granting leave may also be established, for example:

  • employees whose child went to first grade - for one day - September 1st;
  • weddings of employee's children;

This list is open, i.e. The collective agreement may also establish other cases of granting leaves without pay.

Vacation at your own expense - only at the request of the employee

An employer cannot send an employee on leave without pay at its discretion. This action will lead to a violation, which is subject to penalties under Article 5.27 of the Code of Administrative Offenses of the Russian Federation.

In this case, the official or individual entrepreneur will be given a warning or a fine in the amount of 1 to 5 thousand rubles . In case of repeated violation, a fine will be imposed in the amount of 10 to 20 thousand rubles . A director may be disqualified for a period of one to three years. The company will be fined from 30 to 50 thousand . In case of repeated violation, the fine will be from 50 to 70 thousand rubles.

If the organization's activities are suspended

Is it possible to place employees on administrative leave if there is a break in the employer’s activities? Contrary to popular practice, this is prohibited! In accordance with Article 128 of the Labor Code of the Russian Federation, a mandatory condition for granting leave at one’s own expense is the employee’s initiative. If the activity is temporarily not carried out, you can register a downtime.

Helpful information

"Vacations" at their own expense have some features. For example, certain provisions for paid leave do not apply to unpaid leave.

  1. If a person did not have time to rest at his own expense this year, in accordance with labor legislation, then the unused days will not be carried over to the next year, as is the case with the main vacation.
  2. If during the period of free rest an employee suffers from illness, then sick leave will not be paid to him and the rest will not be extended due to illness.
  3. For length of service, only 14 days of unpaid “vacations” are taken into account.

Attention! Additional days of rest can, by agreement of the parties (boss and retired employee), be replaced by cash payments. The exception is working in hazardous industries.

Documentation

Vacation without pay should be formalized by a regulatory act - an order or directive - in form T-6 . The basis is the employee’s statement. The document is signed by the head of the organization. The employee is also required to sign that he has read the order.

When going on unpaid leave, there are no vacation accruals, so a calculation note in the T-60 form is not issued.

Information about the leave granted should be entered in the employee’s personal card T-2 , in section VIII. The T-54 personal account card is also filled out

The employer may use similar documents developed independently.

Registration procedure

Free leave must be properly documented . This happens in accordance with the following algorithm of actions:

  1. Submitting an application.

  2. With its help, the fact is confirmed that vacation is an initiative of the subordinate himself , and not his management.
    The application is written in a standard format: - header - in the upper right corner the position, surname and initials of both the manager and the employee are indicated;

    title — the word “statement” is placed in the central part of the document;

    - main text - here the employee’s request to grant him leave is formulated, and the reasons for this and the required duration are indicated (ideally, it is worth making a reference to the legislative framework - the relevant law or article from the Labor Code of the Russian Federation);

    date, surname and initials, signature.

    The application can be prepared either manually or using computer technology. However, the employee’s signature must be made personally by hand.

    In addition, the employer has the right to request from a subordinate to provide documents that indicate the reasons for receiving additional days of rest (child’s birth certificate, certificates, death certificate).

    Exactly what documents are attached to the application must be indicated in it.

    In some cases, an employee may provide them not before taking leave, but after it ends, because some of the papers cannot be obtained in advance. If he does not do this, the employer will have the right to bring him to disciplinary liability (even dismiss him under the article for absenteeism).

    In the event that a subordinate belongs to one of the preferential categories, he may also be required to provide documents confirming this (pension certificate, disability certificate, etc.).

    In most cases, copies of these papers are already available in the employee’s personal file, but it would be advisable to attach another copy to the application.

  3. Consideration of the application and decision-making by the manager.
  4. If the satisfaction of this request is his right, then he himself can decide whether the specified reasons for this are valid or not. In cases where this is mandatory, he has no right to refuse to provide it, so he can only make a positive decision.

  5. Issuance of the corresponding order.

    It is formed on the basis of the submitted application and is drawn up according to the established form T-6 .

    After preparing this order, the subordinate must be familiarized with it against signature.

  7. Making changes to your personal card.
  8. An entry is made in the corresponding line with the start and end dates of the vacation. The employee must be familiarized with this record (also against signature).

  9. Adjustment of working time sheets.
  10. The mark that is made in it depends on the grounds stated by the subordinate:

    BEFORE — his departure has been agreed upon with management;

    - OZ - for this he has reasons provided for by law;

    UD — the purposes of provision are related to training;

    DB — free leave is annual and additional (for example, if it is enshrined in the local acts of the enterprise).

As for the work book, no entries are made in it. It is worth considering that when applying for a free vacation, the following consequences arise:

  • if an employee gets sick, he will not be able to issue a sick leave certificate and receive payment for it (except for cases when it is issued in connection with pregnancy and childbirth);
  • when working on a probationary period, this leave is not counted towards it (that is, the probationary period is extended);
  • during absence from service on this basis, a subordinate cannot be dismissed on the initiative of the administration (dismissal is possible only upon liquidation of a legal entity or termination of the activities of an individual entrepreneur);
  • days unused during one year cannot be transferred to the next period;
  • When determining average earnings, days of absence from work without pay are not taken into account.

All these nuances and risks must be taken into account before applying for a free vacation. In addition, certain consequences may relate to the procedure for calculating length of service for a given period.

Is it possible to recall an employee from vacation?

According to Article 125 of the Labor Code of the Russian Federation, an employer can only recall an employee from annual paid leave. Recall from unpaid leave is not permitted . This ban also applies to other types of vacations, including educational ones.

Despite the current prohibition, an employee may interrupt his vacation at will. Voluntary return to work does not contradict the Labor Code. In this case, either of the two parties can initiate the termination of the vacation. It is only necessary to agree on all the conditions for early exit.

There are two options for recalling an employee from vacation:

  1. The employee himself expressed a desire to interrupt his vacation. In this case, he should write a free-form application addressed to the manager about early return to work.
  2. When the employer is the initiator of the recall, the employee must be given notice of the early termination of leave. The employee must give his consent or refuse. If the answer is positive, consent to recall from vacation must be documented. Based on the written consent of the employee, an order to recall from vacation and return to work is issued in free form. All changes are entered into the employee’s personal card.

In the modern world, a person who works in any position has certain rights and responsibilities. Everyone is obliged to know them. Each employee is given leave on time. In order to notify your boss of your intention to take the required time off, you must write a statement.

An application is an official document that is based on the desire and request to provide vacation without any maintenance or benefits for a certain period, possibly a maximum, at one’s own expense. A sample order is usually kept by the secretary.

If the organization has only one employee

Often a company has only one employee - its director. Does he have the right to take vacation at his own expense? Yes, it is quite. There are no legal restrictions. However, this process has its own nuances.

Before the director goes on such leave, he must be appointed. O. manager - temporarily performing his duties, vested with the right to sign. After all, a company cannot operate without a leader. It must pay taxes, submit various forms of reporting and conduct business activities, which must be recorded and documented.

Duration of leave without pay

Maximum term

If leave is provided at your own expense, which is mandatory (see table above), then its maximum is regulated by law. For example, a disabled person can count on a vacation of up to 60 days a year. In case of death of close relatives, wedding, birth of children, up to 5 calendar days are allowed.

The duration of administrative leave may change upward, but this is the employer’s right , not his responsibility.

The maximum period of additional leave provided to an employee without pay is determined by agreement with the employer. It can be either several hours or several years.

Vacations lasting more than 14 calendar days per year are not included in the length of service taken into account when determining the right to the next paid vacation. Insurance premiums for this period are also not charged.

Minimum duration

Vacation without pay can be granted even for a few hours. The employee must indicate the desired period in his application - it is written in free form.

In sections “B” and “C” of the order for granting leave in Form No. T-6, columns are entered to indicate the number of hours. Section VIII of the employee’s personal card contains information about the leave provided, and the time sheet contains the actual hours worked.

Let's say an employee takes 3 hours off. His normal working hours are 8 hours a day. In the working time sheet, the total duration of work is indicated by the number “01” or the code “I” , and the vacation time is indicated by the number “16” (code “TO” ). Payment is made according to the hours indicated on the timesheet.

The following options are possible for providing an employee with leave (legal release from work) for just a few hours :

  1. If you regularly use this type of leave, it is necessary to establish, on the basis of Articles 72, 93 of the Labor Code of the Russian Federation part-time mode:
      in the additional agreement to the employment contract, specify the exact start and end times of work, the deadline for installing this mode, as well as the length of the working week;
  2. In the time sheet it is necessary to indicate only the hours actually worked, because wages directly depend on their number.
  3. If this type of leave is used irregularly or if the employee is absent for less than 4 hours per working day, leave without pay should be taken out. There is no minimum duration provided for by law.

Paid and unpaid

An employee of retirement age is given the opportunity to take a break from work several times a year:

  1. Planned vacation. It is given, like everyone else, once a year for twenty-eight days, and is fully paid for. It is possible to get one twice, but only for those working in the North.
  2. Unscheduled , without saving income. A labor veteran has the right to receive it upon first application at any time - this is his legal benefit. The duration is negotiated with the employer. As a general rule, a working pensioner has the right to two additional weeks, a disabled person - to two months, a participant in military operations - 35 days.
  3. For child care. If the mother, due to objective reasons, cannot provide full-fledged care for the child, the father, grandmother, and grandfather can also be involved in the care and troubles associated with the newborn. Then you need to collect a number of documents and contact the employer with a request to provide leave “for children”. If the need is documented, there will be no refusal.

Attention: in the latter case, it is not necessary to provide papers about the mother’s health condition. But in their absence, the director will most likely refuse.

According to Article 126 of the Labor Code of the Russian Federation, a working pensioner can also replace unused vacation with monetary compensation .
