From 01.04.2021 The Order of the Ministry of Health and Social Development of Russia dated April 12, 2011 has lost its relevance. No. 302n. It regulated the procedure for conducting mandatory preliminary and periodic examinations (professional examinations) of workers involved in heavy work and in those workplaces where there are dangerous and (or) harmful working conditions, and approved a list of harmful and (or) hazardous production factors and work, with fulfillment of which these mandatory preliminary and periodic medical examinations of employees were carried out.

Is a medical examination required now? For some workers, definitely yes. On the day when the Order of the Ministry of Health and Social Development of the Russian Federation No. 302n lost force, a new Order of the Ministry of Health of the Russian Federation on medical examinations, No. 29n, came into force. It was registered with the Russian Ministry of Justice on January 29, 2021. and its effect now extends for the next 6 years - until 04/01/2027. This order establishes new requirements, which for the most part reflect the usual norms of the previous regulatory document regarding the procedure for undergoing a medical examination of employees when applying for a job and during subsequent work activities. HOW TO INDICATE THE NAMES OF HARMFUL AND DANGEROUS FACTORS WHEN COMPLETING A LIST FOR A HEALTH EXAMINATION?

The Ministry of Labor of the Russian Federation, in letter dated March 4, 2021 No. 15-2/OOG-581, provided an explanation on how to indicate the name of harmful and (or) hazardous production factors and types of work when compiling a list of workers sent for mandatory medical examinations.

Explanations were provided in connection with the entry into force of a new procedure for conducting medical examinations on April 1, 2021:

– joint order of the Ministry of Labor of Russia No. 988n and the Ministry of Health of Russia No. 1420n dated December 31, 2020 “On approval of the list of harmful and (or) hazardous production factors and work, during the performance of which mandatory preliminary medical examinations are carried out upon entry to work and periodic medical examinations”

– order of the Ministry of Health of Russia dated January 28, 2021 No. 29n “On approval of the Procedure for conducting mandatory preliminary and periodic medical examinations of workers provided for in part four of Article 213 of the Labor Code of the Russian Federation, the List of medical contraindications for carrying out work with harmful and (or) hazardous production factors, and also work during which mandatory preliminary and periodic medical examinations are carried out.”

With the entry into force of the new document, the order of the Ministry of Health and Social Development of Russia dated April 12, 2011 No. 302n.

It is noted that when an employee is exposed to harmful and (or) dangerous factors of the labor process and the production environment, mandatory preliminary upon entry to work and periodic medical examinations are carried out if maximum permissible concentrations (MPC) and maximum permissible levels (MPL) of factors in the workplace are exceeded, starting from subclass of working conditions 3.1 and higher.

Exceptions include only chemical substances - allergens, chemical substances hazardous to human reproductive health, chemical substances with highly targeted effects, carcinogens of any nature, aerosols of predominantly fibrogenic action and chemical substances for which maximum permissible concentrations (MACs) have not been developed.

In accordance with paragraphs 10, 21 of Chapter III of Order No. 29n, when compiling a list of contingents, the following must be indicated:

  • name of the employee’s profession (position) according to the staffing table;
  • the name of harmful and (or) hazardous production factors, types of work in accordance with the appendix to Chapter III of Order No. 29n, as well as harmful production factors established as a result of a special assessment of working conditions.

In this regard, when compiling a list, it is recommended to use the names of harmful and (or) hazardous production factors and the list of work performed, contained both in Order No. 988n/1420n and in Order No. 29n.

Who undergoes a medical examination and how often?

Order of the Russian Ministry of Health dated January 28, 2021. No. 29n changed the procedure for conducting a medical commission for those who are undergoing examination in accordance with the requirements of Article 213 of the Labor Code of the Russian Federation, to establish the fact of fitness for health reasons to perform the assigned work, prevent occupational diseases, as well as preserve the health of the population, prevent situations that contribute to the emergence and spread of diseases. Thus, according to the new Order, preliminary and periodic medical examination of workers is mandatory for workers:

  • those involved in work with harmful and (or) dangerous working conditions (including underground work), and in work related to the movement of vehicles;
  • food industry organizations, public catering, trade, water supply facilities, medical organizations, child care institutions and some other employers that are surveyed in order to preserve the well-being and health of the population.

Medical examinations for organizations where workers have contact with food products during their production, transportation, storage and sale have undergone changes. Clause 23 of the Appendix to Order No. 29n actually combined clauses 14, 15 and 26 of the Appendix to Order No. 302, but according to it, it is not necessary to send all employees of public catering organizations, trade, buffets, catering units (including in transport) for a professional examination. , but only those who directly touch food products during their production, transportation, storage warehouses, etc.

Preliminary medical examinations (examinations) are required when applying for a job:

  • workers engaged in work with harmful and (or) dangerous working conditions: increased microclimate temperature, decreased microclimate temperature, reduced illumination of the working surface, work with vibrations, noise, ultrasound, infrasound
  • traffic related workers
  • employees of food industry organizations
  • catering and trade workers
  • water supply workers
  • employees of medical organizations
  • childcare workers

Based on clause 27 of the Appendix to Order No. 29n, it became mandatory to undergo an examination for everyone who works in medical organizations. Whether it is a security guard or an accountant of a medical institution, if he is officially employed there, then he, along with medical personnel who were examined at certain intervals and previously at the request of clause 17 of the Appendix to Order No. 302, is included in the list of employees subject to preliminary and periodic medical examination. A similar requirement is imposed on all those who perform work in public utility and consumer services organizations.

It should be noted that comments regarding items excluded from Order No. 29 on work in swimming pools, hotels, pharmacies, as well as work performed by conductors and students of educational organizations of general and vocational education before and during internship in organizations whose employees are subject to examination , at the moment not a single department or federal service has given.

Otherwise, the editors touched on the wording of the work being performed, the names of the VOPF, and for the most part brought some clarity to previously controversial issues.

In turn, the frequency of medical examinations to obtain a conclusion or medical examination is established by the appendix to Order No. 29. For the most part, after a preliminary medical examination, employees are examined once a year or every 2 years. An annual medical examination is required for workers under 21 years of age. Extraordinary medical examinations are carried out if there are recommendations from specialists based on the results of medical examinations and/or after the employee’s incapacity for work.

The Ministry of Health explained that such medical examination will be carried out in two stages. The first includes seven mandatory studies. These include a general and biochemical blood test, measurement of blood oxygen saturation, a 6-minute walk test, spirometry, chest x-ray, appointment with a therapist, and an analysis to determine the concentration of the D-dimer protein fragment in the blood, which helps to identify signs of blood clots. All these examinations can be completed in one day.

Based on their results, doctors will determine the risks of developing chronic diseases, and if necessary, to clarify the diagnosis, they will refer the patient to the second stage, the department emphasized. It will include three more examinations - echocardiography, CT scan of the lungs and Doppler examination of the vessels of the lower extremities. If the doctors’ suspicions are confirmed, the patient will be referred for treatment or medical rehabilitation.

Russians who have had moderate and severe forms of coronavirus will be invited to an in-depth medical examination. On their own initiative, those who have had a mild form of COVID-19 or have no official data on them having had the disease will be able to take it. According to Oksana Drapkina, chief physician specialist at the Russian Ministry of Health, late thrombosis can occur after COVID-19 even in patients who experienced the infection relatively easily.

The list of medical organizations where it will be possible to undergo in-depth medical examination will be published on the official websites of regional health authorities and on the unified government services portal. It is planned that more than three thousand clinics in different regions of the country will take part in it.

If the results of the medical examination reveal serious complications from COVID-19, the patient will be sent to rehabilitation

Simultaneously with the in-depth medical examination, a planned one will be carried out. Today, it can be completed once every three years by citizens under the age of 40 and annually by those who have already turned 40 years old. For the latter category of patients, it includes an international system of cancer screenings from the seven most significant locations and additional health screenings for those over 65 years of age. According to Health Minister Mikhail Murashko, the volume of preventive medical care provided to the population will increase annually. By 2024, regular medical examinations will cover at least 70% of Russians.

An unvaccinated employee may be suspended from work for refusing mandatory vaccination if it is established in the region by a decree of the Chief Sanitary Doctor. This was announced by the Minister of Labor and Social Protection Anton Kotyakov.

He explained that the decision to carry out preventive vaccinations is made based on epidemic indications in a particular region. “For workers listed in the document, vaccination becomes mandatory. If the employee has no objective reasons for not being vaccinated, then during the epidemic the employee may be suspended from duty without pay,” the minister said. The suspension is valid for the period for which compulsory vaccination is introduced. Dismissal of an employee for refusing vaccination is not provided for in Russian labor legislation.

Against the background of a surge in the incidence of COVID-19, a number of regions have introduced mandatory vaccination for certain categories of citizens. It mainly concerns employees in the areas of catering, education, trade, personal services, housing and communal services and energy, as well as employees of beauty salons, fitness clubs, transport, theaters, museums, etc.

What documents are needed to undergo a medical examination and what is included in it?

When presenting for a medical examination, the employee must have a passport, a referral from the employer, SNILS, a certificate of a completed psychiatric examination (if required) and, innovation, a compulsory medical insurance or voluntary health insurance policy. The examination includes examination according to a list of different doctors. What kind of doctors they will be depends on the type of work performed by the employee. At the same time, each employee is examined by a therapist, a neurologist, a psychiatrist and a narcologist, and the commission is headed by an occupational pathologist. For women, an examination by an obstetrician-gynecologist is required (for men there are no additional examinations). All employees are prescribed tests. They must undergo a general blood test, a clinical urine test, and women undergo bacteriological and cytological examinations. In addition, everyone is sent for fluorography, and women are prescribed mammography of both mammary glands in 2 projections (after 40 years) and ultrasound of the pelvic organs.

What surveys will be carried out in 2021?

The basis for undergoing a medical examination is a referral issued by the employer. Direct medical examination is carried out in medical institutions licensed to carry out relevant activities in the field of healthcare. The result of the examination is obtaining a medical report. The document is issued in three copies. One remains with the employee, the second is given to the employer and the third is filed in the archives of the medical institution.
