An authentic document has the following characteristics:

  • the color of the original form is uneven: at the edges it is slightly darker than in the center, with a faint purple tint;

  • if the sick leave is genuine, then the number can be clearly felt with your fingers;

Gross violations in the section that is filled out by the medical institution (incorrect name or address of the organization, unspecified period of inpatient treatment, etc.) are not clear evidence of forgery - perhaps a mistake was made by an employee of the medical institution.   • arrest – up to 6 months

Request to the medical institution and the Social Insurance Fund

A visual check helps to identify a fake if the sick leave is issued on a non-original form. However, there are situations when fraudsters receive genuine forms and fill them out with false information. In this case, it will be a little more difficult to establish a fake sick leave.


First of all, it is worth checking whether such a medical institution exists and trying to obtain information there. To do this, it is better to send an official request, if possible on the organization’s letterhead, and attach a copy of the sick leave to it. The letter asks to indicate whether the institution actually issued a sick leave certificate with such a number. It is also advisable to indicate how the author wants to receive a response (by email or regular mail, by phone, by fax).

However, some hospitals may refuse to provide information, citing medical confidentiality. In this case, you can contact the FSS with a request to check the questionable document. If a fake is discovered

If the employer detects the fake immediately, he has the right not to pay for the fake sick leave and register the time of absence as absenteeism. The decision to fire an employee or not is made at his own discretion. The fact of providing false sick leave in itself cannot be a basis for dismissal, but the employer has the right to terminate the employment contract for absenteeism (Article 81 of the Labor Code of the Russian Federation).

It must be taken into account that the employer cannot independently decide on the invalidity of the sick leave provided. If the employee insists that the document is genuine, it must be sent for examination to the FSS and wait for the result. Until then, it is impossible to apply disciplinary sanctions to the employee.

Important! If the certificate of incapacity for work was paid, and then the Social Insurance Fund employees discovered a fake, the employer can withhold the payments made from the employee, but not more than 20% of the salary (Articles 137-138 of the Labor Code of the Russian Federation). Forgery of documents is punishable by law, so an employee can also be brought to criminal liability under Art. 159.2 and Art. 327 of the Criminal Code of the Russian Federation. This can only be avoided if he proves that he did not know about the invalidity of the sick leave (for example, he turned to a private doctor for treatment and did not know that he issued a fake document). However, the employer decides whether to report the detected violation to the police. Since this crime is not particularly serious, it is not necessary to inform law enforcement authorities about it. However, this can be done by FSS employees, and then the employee will still have to answer.

Responsibility for forgery

A disciplinary sanction is imposed on an employee for forgery of a strict reporting document. There is also criminal liability. It is charged on the basis of a claim from the employer or the Social Insurance Fund. The claim must refer to Article 327 of the Criminal Code of the Russian Federation. If an employee received temporary disability benefits, he may also be charged with Article 159.2 of the Criminal Code of the Russian Federation (fraud). The employee may have the following responsibilities:

  • Up to 3 years of imprisonment.
  • A fine of up to 120,000 rubles.
  • Correctional work.

When filing a claim, the employer pays for all examinations to establish the authenticity of the document. If the fact of forgery is proven, compensation for expenses in the appropriate amount can be requested from the employee.

  • Color. The middle of the original document is bluish. Its edges are darker, with a hint of purple. The lines in which all patient data is entered have a slightly yellow tint. Fake paper, as a rule, is either paler or brighter in color. The lines for entering information are white.
  • Paper. The paper of the original document is quite thick and rough. It is similar to the paper on which banknotes are printed. When you shake it, a characteristic rustling sound is heard. A fake sick leave certificate is printed on thinner and smoother paper.
  • Surface. There is a background grid on the paper. It is only missing in the field in which the doctor puts his signature. The document is created using several types of security fibers: blue (brighter), pink and green (dimmer). Under an ultraviolet lamp, all fibers are clearly visible. A document that is not genuine will not have a background grid. Its fibers are of the same shade, which is especially noticeable under ultraviolet light.
  • Barcodes and microtexts. There is a 12-character barcode in the upper right corner. The field where the doctor puts his signature is underlined with microtext. It is also present in the signature fields of the manager and chief accountant. You can see the microtext under a magnifying glass. On the fake sheet there is only a line for underlining. This document may not contain binary code. This cannot be considered a sign of counterfeit.
  • Form number. The main way to determine forgery is the form code. It can be felt on this document, since it was made using the typographic method. The smoothness of the number should raise suspicions.
  • Water marks. The sheet needs to be looked at through the light. It must have watermarks: the FSS logo, a full explanation of the abbreviation, and also two pieces of ears of corn. A fake document either has no watermarks at all, or they differ in appearance.
  • Checking using special equipment. For verification, you can use a regular cash authenticity detector. Under ultraviolet light, the blue and yellow colors on the letterhead turn green and red. The text becomes impossible to distinguish. If the text remains under ultraviolet light, this is a clear sign of forgery.
  • Errors in sections. For example, the name of the medical institution and its address are incorrect. The full name of a doctor who does not work in the specified clinic is also indicated.

IMPORTANT! The employer is recommended to take the original sick leave certificate and compare it with the submitted document.

Reasons for which confirmation of the disease is necessary

Verification of sick leave is necessary in cases where the employer has good reasons to doubt the illness of his employee. Also, a discrepancy in the appearance of the document may prompt the need to check the sick leave certificate.

If assessing the authenticity of a document based on the quality of the paper seems insufficient to you, “arm yourself” with a telephone and call the medical organization that issued it. Since all certificates of incapacity for work are subject to strict recording, information will be found on all actually issued papers: both originals and duplicates. It should also be taken into account that sick leave can be issued to an employee not only in a state, but also in a private medical organization, and not only in the locality where he actually lives, but also in another city, for example, if the employee fell ill during a business trip. Therefore, first check whether such an organization exists in principle, and then check with its employees whether they have issued a certificate of incapacity for work to an employee of your company.

Some clinics refuse to provide information regarding the issuance of sick leave certificates because they believe that this violates the rights of their patients. If there is no other option, write an official request on the organization’s letterhead or send by fax with approximately the following content:

We ask you to confirm the authenticity of the sick leave certificate with number No. 123456789012 dated November 12, 2018, issued to Ivan Ivanovich Ivanov by your medical institution.

Please note that it is advisable to send a copy of the document along with such a request; you can also specify how you want to receive a response: by mail (then enter the address), by e-mail (enter the e-mail address), by phone or fax (write numbers). The signature of the manager and the date of application must be included.

If you do not want to contact a medical institution, you can contact directly the territorial branch of the Social Insurance Fund where the company is registered and ask to confirm the authenticity of the issued sick leave by number. The employees will help you understand the situation, but most likely you will have to come to the Fund and show the document the employee brought.

It is important not to delay checking. The employer is given only 10 days to calculate the benefit. And violation of this deadline may result in liability if the employee wants to complain about the company to the labor inspectorate.

Who cannot issue sick leave?

In accordance with the order of the Ministry of Health and Social Development of the Russian Federation dated June 29, 2011 No. 624n “On approval of the Procedure for issuing certificates of incapacity for work,” medical workers do not issue certificates of incapacity for work:

  • emergency medical services organizations;
  • blood transfusion organizations;
  • reception departments of hospital institutions;
  • balneological hospitals and mud baths;

What to do if the site verification fails?

If there are any doubts about the authenticity of a certificate of temporary disability or identification of invalid forms, the Social Insurance Fund recommends that employers contact the territorial bodies of the Federal Social Insurance Fund of Russia. You can also contact the medical organization indicated on the sick leave for confirmation that such a document was actually issued by its employee.

The application must include the following information:

  • Name of the organization;
  • TIN/KPP of the policyholder;
  • registration number in the Social Insurance Fund;

    The menu downloads the spreadsheet file. By opening the document, the employer can see the availability of the sick leave of interest. To do this, he needs to open the document search window (key combination Ctrl+F) and enter the BL number. If the file does not contain information on this number, then the document is valid or has not yet been issued with this number.
  • Method 2. In the policyholder’s personal account, enter the employee’s sick leave number and SNILS. After that, click Search. The site will process the information and produce a list that matches the request. If the BC with such a number is valid, the employer will see it in the list.

Important. If an invalid or false certificate of temporary disability is detected, the employer should not accrue benefits based on the document. If payments were assigned, they must be stopped immediately, since the Social Insurance Fund, in accordance with Art. 11 Federal Law No. 165-FZ, does not reimburse payments for invalid BC.

  • On the website www.fss.ru : to check the sheet, you must go to the “Invalid forms of disability sheets” menu, which is located in “Information for employers (reporting forms, forms)” and enter the document number.
    This way you can find out whether the form is listed in the lost or lost database. The disadvantage of this method is that the form number may be entered incorrectly, and also that its details have not yet been entered into the database - the database is updated once a month.
  • Request to the medical organization to which the document was issued .
    To do this, you can contact the hospital by phone and find out the information you are interested in about the severity of the work injury or the fact of the disease, or send a written request. The disadvantage of this method is, first of all, the possibility of obtaining a refusal in accordance with the law “On the fundamentals of protecting the health of citizens in the Russian Federation.” It may also take some time to respond to a written request.
  • Request to the Social Insurance Fund office . The only disadvantage in this case may be the time it takes to receive a response, but in this case the organization receives a written response from the Federal Social Insurance Fund of the Russian Federation, and if payments are allowed on an illegitimate sick leave, the employer will avoid punishment in the form of fines and penalties for assigning payments on a forged document.
