The state duty is:

The duties are established by Article 333.33 of the Tax Code of the Russian Federation, subparagraph 30.

  • State registration of an agreement for participation in shared construction:
  1. between a legal entity and an individual: the individual pays 350 rubles, divided by the number of parties to the agreement; legal entity – 6,000 rubles, divided by the number of parties to the agreement;

State duty amount

For registration of real estate, transactions and obtaining the owner's rights, a certain amount of money is charged - a state duty. Since 2015, the Tax Code of the Russian Federation has undergone changes, as a result of which the state duty for registering ownership of real estate is:

  • 22,000 rubles – legal entities (organizations);
  • 2000 rubles – to individuals (citizens).

These amounts are valid for registration of ownership, operational management rights, lease, etc. Registration takes place under contracts of exchange (barter), purchase and sale, contracts for the division of property or donation for various structures, buildings, apartments and premises.

Registration of rights to real estate is carried out only if there is a payment document. Submitting an application without a receipt is impossible, otherwise Rosreestr employees will reject it. The type of property must be taken into account - the amount of payment depends on the type of registration actions. It is logical that the cost of the state duty for registering ownership of an apartment and the state duty for a small area for the construction of a garage will differ significantly. In order not to make a mistake with the amount of the fee and to show up with a correctly paid receipt, the main types of payments are discussed below.

State duty for land registration

For the acquisition of ownership rights to land, the purpose of which is personal use (dacha farming, garage structures), a fee of 350 rubles is charged. Registration of your share in the common ownership of the agricultural zone will cost 100 rubles. However, the duty on a land object that contains real estate includes both the amount for the plot and the building. The total payment will be 2350 rubles: 350 rubles. for the territory and 2000 rubles. for the house.

State duty for mortgage registration

Mortgage registration is not subject to a fee only for a purchase and sale agreement using a loan. In this case, you only need to pay for the right to register. But if a sum of money is taken as collateral for an apartment or private house, the tax will be 2,000 rubles. for individuals and 22,000 for legal entities. By opening a bank loan secured by real estate, a restriction of the right is registered in the form of a mortgage. Two parties to the transaction (bank and individual) undertake to pay the state duty. For a bank the amount will be 11,000 rubles, for a private person – 1,000 rubles.

State registration fee

Registration at the place of residence is popularly called “propiska”. As with registration at a temporary place of stay, there is no state fee for registration of a citizen of the Russian Federation. The process of deregistration is also carried out absolutely free by the Federal Migration Service.

But foreigners and stateless persons will have to pay to register at their place of residence in Russia. In such cases, the state fee for registration in an apartment is 350 rubles.

Budget classification codes for 2021. Government duty

  • if the contract is concluded by individuals - 1000 rubles (in total);
  • between legal entities - 4000 rubles (in total);
  • and individuals and legal entities, with the exception of an agreement giving rise to a mortgage on the basis of the law - 1000 rubles in the amount (clause 28.1 of Article 333.33 of the Tax Code of the Russian Federation).

Expert opinion Commented by lawyer Alexander Vasiliev A mortgage on the basis of the law arises without concluding a separate mortgage agreement, when the buyer has not paid the price of the real estate before contacting Rosreestr. Based on clause 5 of Art. 488 of the Civil Code, the property will by default be pledged to the seller until the price is paid in full. The mortgage will be registered by force of law without paying state duty in accordance with Part 2 of Article 20 of the Federal Law.

The seller and buyer may not establish a mortgage by operation of law. To do this, it is necessary to directly indicate in the contract that paragraph 5 of Article 488 of the Civil Code does not apply, and the property will not be pledged to the seller.

From April 6, 2021, the admission of applicants in all areas of the institution’s activities has been suspended.

The operation of the online appointment pre-registration service has also been suspended. Previously made appointments are automatically cancelled. Changes in the operation of the institution are related to the introduction of a general self-isolation regime and will remain in effect until further notice.

Changes in the organization of work of the St. Petersburg State Budgetary Institution “Gorzhilobmen” and the resumption of the service will be announced additionally.

In addition, it is proposed to request payment details for information from the Unified State Register via the Internet. For example, by: - searching for information on the State Services website; - using the official Rosreestr page. It is better to use the second option. Changing payment details for Rosreestr services

Real estate transactions have a special legal status: both the object of sale and purchase and the rights to it are registered by concluding an agreement. From a legal point of view, real estate is considered:

  • Apartments, houses.
  • Land.
  • Non-residential buildings.
  • Objects purchased under mortgage agreements.
  • River/sea vessels, transactions for which are displayed in the State Ship Register.
  • Other types of real estate.

To officially take legal ownership, it is not enough to purchase an apartment, house or plot. A prerequisite is the registration of rights to real estate, which is carried out by Rosreestr. This service is a paid one and involves payment to authorized institutions/bodies the amount of money established by law in the following cases:

  1. Termination or emergence of rights under transactions of purchase and sale, inheritance, donation, etc.
  2. Restriction of rights, for example, in case of mortgage, alienation, etc.
  3. The emergence of use rights to objects owned by other persons. For example, for long-term rentals, etc.

Note! Such a mandatory payment is included in the tax system of the Russian Federation, since the procedure for its payment and return is regulated by chapters. 25.3 Tax Code of the Russian Federation.

The state fee for registering ownership of real estate can be paid in several ways. Choose the most convenient one, but do not forget to carefully check that the receipt is filled out correctly, because the speed of transaction registration depends on this. Available options for transferring funds:

  1. Through a bank operator - the most popular method, involves the payer personally contacting a bank branch, for example, the territorial office of Sberbank. You will need a passport and a pre-filled receipt form. Be prepared to pay a small commission.
  2. Through self-service terminals - payment can be made in cash or using a personal plastic card.
  3. Via the Internet - you can pay the state duty through the Sberbank-online service. Pre-registration of the user and receipt of a password is required.

The result of the transfer of money will be the receipt of a check confirming the fact of settlements with the budget. The document must be retained for further presentation to the registration authority for its intended purpose. Remember that you must pay the state fee for registering rights to a property before completing the transaction.

In some cases, real estate lease agreements are subject to state registration (Clause 2, Article 609 of the Civil Code of the Russian Federation). We will tell you about the amount of the state fee paid for registering lease agreements in our consultation.

If a lease agreement for a building or structure is concluded and the term of such lease is 1 year or more, such an agreement is subject to mandatory state registration and is considered concluded from the moment of such registration (clause 2 of Article 651 of the Civil Code of the Russian Federation).

Similarly, state registration is required for land lease agreements if the agreement is concluded for a period of at least 1 year (clause 2 of Article 26 of the Land Code of the Russian Federation).

The amount of the state fee for registering a real estate lease agreement depends on who applied for registration (clause 22, clause 1, article 333.33 of the Tax Code of the Russian Federation):

  • for an individual the state duty is 2,000 rubles;
  • for an organization – 22,000 rubles.

In terms of the type of rental property, an exception is made for agricultural land. Registration of a lease agreement for such land requires payment of a state duty of only 350 rubles (clause 25, clause 1, article 333.33 of the Tax Code of the Russian Federation).

And the state duty for registering a lease agreement for a land plot that is not agricultural land is generally 2,000 rubles or 22,000 rubles for individuals or organizations, respectively.

The State Register is a service that many citizens encounter. This organization is familiar to all property owners. What documents prove the identity of a citizen of the Russian Federation? How can I find out the details? When making a contribution, you should know the exact details - the state fee for registering property rights in 2021 through the MFC and Rosreestr offices will not go to the budget of the required authority if the payer incorrectly fills out the fields in the receipt form. Particular attention should be paid to the all-Russian code classifier, which is responsible for the distribution of transferred funds.

The first and main change in the system of state registration of rights to real estate is the emergence of the possibility of simultaneously entering information into both the cadastral section of the Unified State Register and the section of the Unified State Register on rights to objects. The basis for entering the relevant information is, in the case of real estate lease, the relevant agreement. This rule is established by paragraph 2 of Art. 14 Federal Law No. 218. For each specific case of contacting a registration authority, the law provides for separate procedures and procedures. For example, Part 4, Clause 3, Art. 14 Federal Law No. 218 provides that simultaneous registration action - cadastral registration and registration of encumbrances on an object - is possible in the event of the formation of part of a building. Indicated in payment orders for the transfer of taxes and contributions, receipts for payment of traffic police fines and other payment documents. In some receipts, instead of UIN, an identifier or index of the document may be written. At the same time, it will always be at the top of the receipt and in its middle.

Attention! When paying via the Internet, you may be asked, when accepting documents, to put a bank stamp on the printed receipt. Of course, this requirement is unlawful, because the registrar will in any case double-check the receipt of the state duty to the department’s account.

From 01/01/2021, the authority to provide information from the Unified State Register of Rights to Real Estate and Transactions with It (extract from the Unified State Register) has been transferred from the Office of Rosreestr to the Branch of the Federal Cadastral Chamber of Rosreestr in St. Petersburg. From June 10, 2021, payment of the state duty for providing information from the Unified State Register must be made to the details of the FKP Rosreestr Branch.

Cases when the state duty is subject to mandatory payment: The procedure for collecting the duty is regulated by Chapter 25.3 of the Tax Code of the Russian Federation. Thus, when registering property rights, payment of the fee falls on the shoulders of the new property owner. The party to the transaction makes the payment independently.

Attention! Payment is made after submitting the request!
