What is temporary registration?

In the Russian Federation, every citizen must have registration at the place of residence.
Place of residence, according to the law of the Russian Federation of June 25, 1993 N 5242-1, means any premises with residential status, where a specific person must reside legally and have a residence permit there. Temporary registration at the place of stay gives the right to:

  • obtaining a bank loan;
  • registering a car and obtaining a driver’s license at the state traffic inspectorate;
  • opportunities to attach to a clinic;
  • registering children for kindergarten or school;
  • get officially employed.

The citizen's permanent residence address is reflected in the passport with the appropriate stamp. But it may not always coincide with the actual stay. In some situations, a person is forced to stay in another city or other locality for quite a long time. These are the cases when a citizen:

  • is employed in a locality that is located far from the registered address;
  • permanently or performs work under a fixed-term contract for a certain period;
  • is on a long business trip;
  • due to circumstances, he is actually forced to live outside his registration;
  • is undergoing long-term treatment in a hospital, or is also staying in a rest home or sanatorium;
  • as a tourist stays in a hotel complex, boarding house, etc.

All these cases oblige the citizen to register temporarily, i.e. obtain the appropriate document.

Temporary registration in an apartment with the consent of its owner gives a person the opportunity to stay in it, subject to compliance with the law, for a certain period of time. You can obtain a certificate of temporary registration in an apartment only with the approval of the owner, who, together with the citizen receiving registration, must appear at the registration authority. On behalf of the owner, the presence of a person with a notarized power of attorney is acceptable.

Exception. A child may move into the home together with a parent or legal representative. Consent for his registration is not required. If the owner does not object to providing temporary registration to parents or guardians, then he does not have the right to prevent their child from registering.

The significant difference between temporary registration and permanent registration is that it is given for a limited period. You can temporarily move and register in new places an unlimited number of times, while only one registration address can be permanent.

The complete absence of any registration is an offense.

For how long can I register?

The period for which the apartment owner is ready to provide temporary registration is determined by him personally. This period is arbitrary, by agreement of the parties, but not more than 5 years. The minimum period is not determined by law.

Without registration, you can stay anywhere for up to 90 days. If this is exceeded, you will need to register temporarily.

The person registered in the apartment temporarily needs to negotiate the payment of utility bills and it is better to secure this clause in the contract.

How to apply for temporary registration?

The simplest registration rules for those staying in hotels, medical institutions, boarding houses and the like. The responsibility to register them at the place of residence rests with the administrative employees of this organization. The citizen is only required to fill out a form and present an identity card.

Temporary registration in case of change of residence will require three stages, namely:

  1. Preparation of documents.
  2. The collected documents must be submitted to the migration service at the place of temporary residence.
  3. Obtaining a certificate of temporary registration.

In privatized housing, temporary registration is carried out with the consent of the owner or owners. Then the person must contact the migration service in person and submit completed forms and documents. In addition, the owner of the property must be present at the FMS to confirm his consent.

If among the documents there is an agreement on social rental housing or on the right of residence , then the authorized body considers the application quickly and issues a certificate of temporary registration within 3 days. In the absence of such an agreement, the migration service has the right to conduct an inspection, which will require additional time. In this case, the period for processing and issuing a certificate should not exceed 8 working days.

When registering temporarily, you can use the electronic service and receive the service on the State Services portal, provided you have an account. The entire package of papers can be sent to the department by mail.

It is important to note that obtaining registration of temporary residence does not oblige a person to deregister at his place of permanent residence.

Let's consider several options for temporary registration in more detail:

  1. In a privatized apartment . Temporary registration is possible only after obtaining the consent of the owner (or owners, if the living space is in shared or common ownership). They are all required to be present at the Federal Migration Service to personally give consent.
  2. In a municipal apartment. Registration in it is possible, according to the Housing Code, for no more than six months. After this period has expired, you can register again. In this case, consent is given by the landlord (the municipality or government body that provides residential space for use) and a sufficient number of meters is required. The norm is 12 square meters. m. for each of the registered. If a child moves into municipal housing together with a parent or legal representative, consent for his registration is not required.
  3. In a mortgaged apartment. Until the loan is repaid, the apartment is held as collateral by the bank. Carefully read the bank agreement to see if it states the borrower’s right to register in the property. If the item is missing, then there are no obstacles. Just warn the bank about this.
  4. In a hospital, hotel, sanatorium, etc. Registration is carried out by the administration of the institution if the citizen stays with them for more than 90 days. If the period is shorter, then temporary registration is not required.

When does the deadline increase?

Despite the fact that the legislative framework establishes specific deadlines for registration, there are exceptions. For example, in Moscow, St. Petersburg and other regional cities, registration may take longer due to severe overpopulation.

Due to the huge queues at registration government agencies in capital and regional cities, the best option is a remote method of submitting documents (the Russian Federation Government Services portal or post office).

The Migration Service is the main body responsible for registering citizens and providing all the necessary information on it. The passport office, the Internal Affairs Directorate, the Ministry of Internal Affairs, the MFC and other related organizations are only intermediaries that are created to control the flow of citizens wishing to register.

When contacting intermediaries, the registration period may increase by 2-3 days.

According to regulations, if there is a need to make a request to the Federal Migration Service, passport office or other government agency regarding emerging issues, registration of a citizen at the required address takes 8 days.

Documentation

Depending on the case, the number of documents when submitted to the registration authority differs.

When appearing in person at the Federal Migration Service you will need:

  • application for registration at the place of stay, the form of which is previously available -;
  • passport of a citizen of the Russian Federation or foreign passport (permanently residing abroad);
  • basis for registration (lease agreement or application signed personally by the owner of the privatized apartment);
  • extract from the Unified State Register of Real Estate when the owner is registered.

They must be submitted in original and copies.

When submitting by post, additionally:

  • a copy of the document for the basis for registration must be certified by a notary;
  • fill out form No. 2 “Address sheet of arrival” in triplicate -;
  • if the registration period exceeds 9 months, then fill in one copy of form No. 12P “Statistical sheet” -.

If minor children are temporarily assigned to housing together with their parents or guardians, then you must attach:

  • birth certificates of each child;
  • passports of parents or legal representatives;
  • Marriage certificate;
  • from the place of permanent registration, an extract from the house register;
  • adoption certificate in case of guardianship.

When a child moves in with one of the parents, the department must provide the consent of the second parent, certified by a notary. In case of divorce, he additionally submits a corresponding certificate.

How long does it take to obtain a temporary registration certificate?

The time spent on obtaining a certificate of registration at the place of residence varies from 3 to 10 days. This directly depends on the method in which you prefer to submit documents.

When visiting the passport office in person

According to regulations, the period for obtaining temporary registration when an applicant visits the passport office in person takes no more than 3 days from the date of submission of documents. You will have to appear at the authorized state body at least 3 times:

  1. Get advice on the necessary documents and make an appointment to submit an application.
