Furniture warranty

Buyer / Warranty for furniture
Warranty period for furniture

According to the "Trade Rules" and the Law of the Russian Federation "On the Protection of Consumer Rights" Chapter I General provisions Article 5 Rights and obligations of the manufacturer (performer, seller) in the field of establishing the service life, shelf life of the product (work), as well as the warranty period for the product (work ) in paragraph 6, the manufacturer (performer) has the right to independently establish a warranty period for furniture (products, services) - the period during which, in the event of a defect or breakdown of the product (furniture), the manufacturer is obliged to satisfy the consumer requirements established by Art. 18 and 19 of this Law. (as amended by Federal Law No. 171-FZ dated December 21, 2004).

The warranty period for furniture is indicated in the passport for the furniture product and can be determined at the discretion of the manufacturer for any period - 12, 18, or 24 months . The warranty provides for free repair of furniture, but does not cover malfunctions and defects caused by the following reasons: * fire, flooding, etc.; * if there are mechanical damages, thermal effects or traces of exposure to chemicals on the furniture surfaces; * malfunctions resulting from normal wear and tear of the product; * deliberate damage to the product or erroneous actions of the consumer (buyer); * in case of improper independent lifting or assembly of the product, making changes to its design; * in case of violation of the rules of operation of the furniture product, as well as after the expiration of the warranty period for the furniture product.

In case of non-compliance with the rules of operation and use of furniture for other purposes, the seller, the manufacturing factory is not responsible for the loss of consumer qualities of furniture or other purchased goods, and servicing and repair of furniture will be carried out according to the decision of the factory, and the provision of repair services - only for buyer's invoice at factory prices! The manufacturer has the right to accept an obligation in relation to defects in the goods discovered after the expiration of the warranty period established by him (additional obligation). (introduced by Federal Law of December 21, 2004

What categories of goods are guaranteed for a certain period of validity?

In Art. 470 of the Civil Code of the Russian Federation and Art. 5 of the Law “On the Protection of Consumer Rights” we are talking about providing a quality guarantee for the entire thing, and not for its individual parts. Study Art. 470 KG of the Russian Federation and 19 of the Law. They clarify that the warranty can also be issued for the component parts of the product.

There is a list of products for which the warranty period is not established. This includes medicines, food products, household chemicals and others. The manufacturer is required to mark the expiration date on manufactured products. This time period indicates when the product becomes unfit for consumption or use.

If we are talking about long-term use of the product, then the manufacturer has the right to determine the service life. It represents the period during which the manufacturer provides the buyer with the opportunity to use the item for its intended purpose.

A special category stands out for products that can cause harm to human health, the environment, or property of the buyer. In this case, the manufacturer is obliged to establish a period of time during which the product can serve the consumer.

As Art. 477 of the Civil Code of the Russian Federation, the client has the right to make claims to the store that are related to product defects if they were discovered during the warranty period. When purchasing a product, the seller is obliged to transfer to the buyer all the necessary components of the product, documentation (product passport, quality certificate, operating instructions), including the warranty card.

They are always provided for by legislative norms, other legal acts, or the agreement itself (Article 456 of the Civil Code of the Russian Federation). Only in individual cases, when the contract specifies other clauses of the purchase and sale transaction, the conditions may change.

Clause 51 of the Rules for the sale of certain types of goods provides information on the transfer to consumers of technically complex products. The seller is obliged to deliver along with the goods the entire set of documents and additional components provided by the manufacturer.

The package of documents includes a passport for the purchased product or other certificate with the specified date and name of the shopping center of the purchase and sale transaction, and operating instructions.

According to Art. 18 of the Law “On the Protection of Consumer Rights”, the client has the right to make claims related to the free elimination of defects only to the distributor or manufacturer.

In this case, the buyer can provide any documentary evidence that confirms the fact of the transaction between the seller and the buyer. This could be a sales receipt, warranty coupon, agreement, receipt or vehicle passport.

Do not forget to provide the buyer with an identification document as a citizen of the country. In Art. 18 of the Law “On the Protection of Consumer Rights” also states that the absence of a warranty coupon, technical passport for a product or instructions that confirm the fact of purchase and sale cannot become an obstacle to satisfying the buyer’s conditions related to the request for a return or exchange.

The law does not require a customer who purchased a product, but decided to return it back to the store due to inadequate quality, to show the seller the packaging.

A warranty coupon refers to documents that officially confirm the obligations of the seller or manufacturer related to the creation of such a high-quality product that would function throughout the entire period specified by the manufacturer.

If the buyer does not have a warranty coupon, or this document was filled out incorrectly, the seller does not have the right to refuse to satisfy the consumer’s request. The latter can use testimony that should confirm the reality of the transaction.

Do not forget about the importance of correctly filling out the warranty card. When filling out the document, pay attention to the exact code, number, production series and other identification features of the product. The seller must also indicate the date of sale, put the seal of the legal entity, his signature, and issue a fiscal receipt.

As you know, you can receive high-quality service only if one important condition is met - the warranty card must be correctly filled out and certified with the seal of the selling party. However, such a requirement contradicts the clauses of the Civil Code of the Russian Federation and the law “On the Protection of Consumer Rights”.

Protect yourself from disputes with the seller or manufacturer and present all relevant documents. Their absence does not give the seller the right to refuse to return or exchange a low-quality product.

As Art. 20 of the Law “On the Protection of Consumer Rights”, defects that have been identified in the item must be removed as soon as possible (unless another time is specified in the agreement signed by the selling and buying parties).

Remember that the company that is responsible for carrying out repair work must fulfill its obligations as quickly as possible after a consumer makes a claim. This is due to the fact that the legislation has not defined specific deadlines for correcting defects.

Therefore, the service center must adhere to the principle of reasonableness and create conditions so that the client feels protected and not infringed on his rights. The duration of troubleshooting depends on the complexity of the fault, the design features of the product, and the timing of repairs determined by individual legislation and standards.

If the period allotted for servicing is violated, then the organization that carries out the repair work is obliged to pay the amount established by law for each day of delay (1% of the cost of the product), unless it provides compelling evidence that the delay is due to the action of a third party or unforeseen situation. This is discussed in Art. 23 of the Law “On Protection of Consumer Rights”.

Request that the distributor or manufacturer provide a similar product if it is a durable product. It can be used during repair work by a service center. Delivery of such a product must be made free of charge within three days from the date of request.

After all defects are corrected, the warranty period is extended for the period during which the item was not used. This period begins from the moment the client submits claims related to the request to remove identified defects until the day of receipt of the repaired product (Article 20 of the Law “On Protection of Consumer Rights”).

The warranty period of a product is the period during which the buyer can make claims to the manufacturer or seller for the low-quality goods he purchased, and the seller is obliged to satisfy these claims. The expiration date begins from the day the product was purchased, but if the day the product was sold is unknown, the starting point becomes the date of manufacture.

“The warranty period can be set by both the manufacturer and the seller - this is stated in Article 5 of the Law “On the Protection of Consumer Rights,” explains Rodion Yuryev, head of the Yuriev Legal Bureau. - However, the seller cannot reduce the warranty period established by the manufacturer - he can only extend it.

It is worth noting that the manufacturer also has the right to set the terms of the warranty. The buyer is obliged to comply with the operating rules and follow the product instructions. For example, a car owner must carry out regular maintenance.

1. Check the list of service centers on the warranty card.

2. Write a complaint that includes your requirements, a description of the defects in the product, the date of purchase, and how you want to resolve the problem, such as a refund or repair. Please also attach a copy of the sales receipt and completed warranty card.

3. Contact the service center with a complaint, do not forget to get the seller’s signature on a copy of the document.

Remember that depending on your requirements, you are entitled to:

  • refund within 10 days;
  • exchange of goods for a new one within 7 days, with additional verification - 20 days;
  • elimination of product defects within 45 days. Remember that during the repair period the seller is obliged to provide you with a similar product and extend the warranty period after repair (Article 20 of the Law “On Protection of Consumer Rights”).

4. If these deadlines are violated, then after their expiration you can sue. Also, according to Article 23 of the Law “On the Protection of Consumer Rights”, you are entitled to 1% of the cost of the goods for each day of delay. Remember that the seller has the right to conduct an examination to determine the nature of the defects of the product. If the product defect is the buyer’s fault, then warranty service may be denied.

In addition, you have the right to contact the Society for the Protection of Consumer Rights or Rospotrebnadzor - these organizations will help resolve the situation out of court.

If the warranty period of the product has expired, the seller has every right to refuse service to the consumer. However, there is such a thing as service life - this is the period during which the manufacturer is responsible for significant deficiencies arising through his fault and ensures the possibility of using the product for its intended purpose (Article 5.

1 of the Law “On Protection of Consumer Rights”). “To be entitled to warranty service in this case, the buyer must prove that the cause of the breakdown is not his fault, and the defects arose due to the fault of the manufacturer even before the delivery of the goods. Of course, this is very difficult to prove in practice. By the way, if the product warranty period is less than two years, and product defects were discovered after the expiration of the period (but within two years), you have the right to service if you prove that the product defects arose before its purchase.

Free furniture repairs under warranty

Furniture repairs under warranty are carried out after filing a claim in writing.
If all conditions are met, then the company carries out appropriate work to eliminate the defects and shortcomings that have arisen.

During repairs, the warranty period is suspended.

The same conditions are observed when considering a case in court.

If the work was carried out independently, then the consumer has the right to receive compensation for expenses incurred.

Important! If the furniture is in a warehouse and the warranty period is already in effect, then these conditions are unfavorable for the buyer and in this case the time for transferring the goods to him should be accelerated.

Over a short period of time, secondary breakdown of furniture requires the fulfillment of certain obligations on the part of the manufacturer:

  • replacement of a product with a similar copy for the period of repair or for permanent use;
  • purchasing other furniture with recalculation of funds;
  • refund of the full amount spent on the purchase of furniture;
  • receiving a significant discount on defective goods;
  • compensation for expenses incurred during self-repairs.

The repair period from the date of filing the application is carried out within 45 days. If, after the lapse of time, a satisfactory decision is not made, then the buyer can assert his claims in court.
Most furniture manufacturers in the domestic market, in the fight against competitors, are establishing service and warranty periods acceptable to their customers. Therefore, all consumer requirements have legal grounds and are satisfied through an agreement between the two parties.

Information about the warranty period is indicated in the passport or purchase and sale agreement. The purpose of service depends on the manufacturer and the type of product purchased.

In exceptional situations, when making a purchase, warranty service is not indicated. Under these conditions, any damage detected is subject to replacement or repair within a period of no more than 6 months from the date of sale.

Important! Making changes regarding the warranty period, as well as the method of delivery of purchased furniture, is possible before signing the contract, since after the document comes into force, all conditions can be agreed upon only on the basis of a mutual decision of the two parties!

What is the legal warranty period for upholstered furniture?

a breakdown during the warranty period requires repairs by the manufacturer, since he must fulfill an additional obligation in the form of a temporary replacement of the product or a refund of money spent;

  • if there is a shortage of component parts, the consumer must notify the company about this nuance and receive the missing elements or compensation for the damage caused;
  • purchasing a product at a reduced price is not always subject to full warranty service, so this aspect must be taken into account when drawing up a contract;
  • Carrying out the appropriate repair work is possible only if the examination reveals manufacturing defects.

In the case where furniture is ordered remotely, the buyer has a number of advantages in obtaining a warranty and the possibility of returning it within 7 days after receiving the goods.

When long-awaited and expensive upholstered furniture appears in the house, no one thinks about guarantees and service life. However, they need to be taken into account at the stage of choosing a sofa. Characteristics, period of use, manufacturer's guarantees: every nuance is important. We suggest you figure out how long upholstered furniture should last, who sets this period, and from what moment the countdown begins.

The service life of a sofa according to GOST is the time period during which the manufacturer guarantees the buyer the quality of the product and, if necessary, bears responsibility for violation of these guarantees. Assembling and disassembling furniture can be done by the consumer independently at home; this does not require special knowledge and skills; just read the instructions carefully. High-quality furniture made using modern technologies does not require additional connecting elements. The main condition for compliance is that the furniture is assembled by at least two people. Illegitimate or incorrect assembly will lead to defects and damage during operation. In this case, the manufacturer declines any responsibility for the breakdown.

From the moment of purchase, the consumer has the right:

  • possession, disposal and use of the product;
  • for repairs and warranty service;
  • to eliminate significant deficiencies free of charge;
  • for damages.

If the period of operation of the sofa is not established, the provision of the above rights is ensured by the manufacturer for ten years. Therefore, most manufacturers reduce the service life of the product by indicating it in the warranty card. According to Article 5 of the Law of the Russian Federation “On the Protection of Consumer Rights” (hereinafter referred to as the Law), the manufacturer has the right to independently determine the duration of the warranty period for the furniture. If during this period significant defects or breakdowns are identified in the product, the manufacturer must satisfy the buyer's claims.

Important: by law, the manufacturer is obliged to repair or replace a product if the latter does not meet the specifications or has hidden (latent) defects that were not identified during a preliminary inspection.

When purchasing a sofa, it is necessary to check all components and inspect the surface for damage. Be sure to keep the packaging, receipt and warranty card. If defects are identified at the time of acceptance and delivery, they must be indicated in the defect report. If the furniture is accepted without recording the defects, the buyer does not have the right to refer to them in the future.

How to return a product for repair under a warranty service agreement?

Leading legal adviser Marina Klepko notes that if the product turns out to be of inadequate quality (with the exception of technically complex goods), in accordance with Article 18 of the Law “On Protection of Consumer Rights” you can demand:

  • proportionate reduction in price;
  • replacing the product with a similar one;
  • free repairs or reimbursement of repair costs;
  • refund.

It is worth mentioning separately about technically complex products. If significant defects are found, you can also count on a refund of the full cost of the product and an exchange, however, such claims can only be made within 15 days after purchase. After this period, only repairs are possible.

Furniture warranty

Additional services Additional services provided by manufacturing factories are provided for an additional fee. Legal warranty period for furniture

However, such a violation must be proven by the results of an independent examination. If experts do not establish violations of operation on the part of users, the manufacturer independently carries out repairs or replaces the broken product.

Operation of guaranteed upholstered furniture

Recommendations regarding the assembly and operation of upholstered furniture are contained in the instructions and must be strictly followed by the buyer. Otherwise, the manufacturer has the right to reject claims against it.

Important: an unassembled sofa must be stored packaged if it was not assembled immediately after delivery.

New upholstered furniture is installed in well-ventilated areas with normal humidity levels. Leather furniture should be placed away from heat sources (fireplaces, radiators, heaters, etc.), and away from direct sunlight. It is not recommended to cover the skin with colored blankets, which can stain it. Do not allow children or pets to eat on the sofa, as this may damage the upholstery and leave stains on it. Avoid contact of piercing, cutting, sharp, or heavy objects with the upholstery.

Important: optimal care for upholstered furniture is cleaning with a vacuum cleaner and a damp cloth. For leather products, it is necessary to use special cleaning products (varnishes, glosses, softeners, protectors, etc.).

Another important nuance that needs to be taken into account when purchasing upholstered furniture is the quality and service life of the filler. Depending on what will be inside the sofa: spring blocks, foam rubber or polyurethane foam, the duration of use of the product depends.

In conclusion, we note that the cost of upholstered furniture often depends on the duration of warranty service. It is initially included in the price. The better and higher the quality of the fillings, upholstery materials and the structure itself, the higher the price of upholstered furniture.

What documents are needed to take advantage of the guarantee?

In order to make the process of returning an item to a store as easy as possible, it is necessary to prove when the item was purchased and in which store. That is why you need to have the following documents with you:

  • cashier's check (or bank statement);
  • completed warranty card.

However, if documents are missing for any reason, this is not a reason to refuse warranty service to the consumer. According to Article 18.5 of the Law “On Protection of Consumer Rights”, the buyer may present testimony of witnesses, oral or written, as evidence.
