Nuances of income information

What documents are needed to recognize a low-income family?

The corresponding status is assigned to a family under the conditions determined by Federal Law No. 44-FZ dated April 5, 2021 “On the procedure for recording income and calculating the average per capita income of a family for recognizing them as low-income and providing them with state social assistance.” Before recognizing a specific family as low-income, the following conditions must be met:

Senchuk: In accordance with Art. 7 of the Law of July 17, 2021 No. 178-FZ “On State Social Assistance”, recipients of state social assistance can be low-income families, low-income single citizens who, for reasons beyond their control, have an average per capita income below the subsistence level established in the relevant subject of the Russian Federation for the relevant group of the population (working population, pensioners, children). To resolve the issue of recognizing a low-income family, it is necessary to submit a written application for the provision of state social assistance to the social protection authority at the place of residence with the following package of documents: - passports of all those registered in the residential premises; - birth certificates of young children; - certificate of family composition; - information about income. Based on the submitted application and provided documents, the average per capita family income is calculated and a decision is made. The procedure for recording income and calculating the average per capita income of a family for recognizing them as low-income and providing state social assistance is established by Law No. 44-FZ dated 04/05/2021. The calculation takes into account the amount of income of family members for the last three calendar months preceding the month of filing the application. According to Art. 1 of Law No. 134-FZ “On the subsistence level in the Russian Federation”, when calculating the average per capita income, a family includes persons related by kinship and (or) affinity, living together and leading a joint household, spouses, their children and parents, adoptive parents and adopted children, brothers and sisters, stepsons and stepdaughters. How is the average per capita family income calculated?

According to Art. 4 of Federal Law No. 44 of 04/05/2003 “On the procedure for recording income and calculating the average per capita family income and the income of a single citizen living alone for recognizing them as low-income and providing them with state social assistance,” the average per capita family income is calculated by social protection authorities by adding up all the incomes of able-bodied family members and dividing the resulting amount among all family members.

That is, if, for example, a family of four, consisting of two able-bodied parents and two minor children, applied for recognition as low-income, then their income will be calculated as the sum of the income of two parents divided by all four family members.

Recognition of a citizen living alone as low-income, accordingly, occurs when calculating his income, and then comparing the amount of income with the subsistence level.

In accordance with Art. 13, in addition to spouses and children, the family that applies for recognition as low-income also includes the parents of spouses, adoptive parents and adopted children, blood brothers and sisters, stepsons and stepdaughters, if they live together and run a common household.

Exception, in accordance with Art. 14 are citizens undergoing compulsory military service, studying in military educational organizations, as well as persons serving sentences in prison organizations and citizens who are fully supported by the state and citizens recognized as unemployed in accordance with the procedure established by law. The income of these citizens is not taken into account when calculating the average per capita family income.

What types of income are taken into account when calculating the average per capita family income?

When calculating the average per capita family income, in accordance with the Decree of the Government of the Russian Federation of August 20, 2003 N 512 “On the list of types of income taken into account when calculating the average per capita family income and the income of a citizen living alone to provide them with state social assistance,” the following types of earnings are taken into account:

  • all labor payments, including vacation and dismissal benefits, redundancy payments and sick leave payments, as well as bonus payments and salary supplements for the last 3 calendar months preceding the date of application;
  • compensation paid by a state body or public association for the performance of state or public duties;
  • pensions, compensation payments (except for compensation payments to non-working able-bodied persons caring for disabled citizens) and additional monthly financial support for pensioners, as well as the monthly lifetime maintenance of retired judges;
  • scholarships for undergraduate and graduate students;
  • Unemployment benefit;
  • Benefit for pregnancy and childbirth, as well as for caring for a child up to 3 years old;
  • Monthly unemployment benefits for spouses who are forced not to work or cannot find a job due to the lack of employment opportunities in their specialty in the place where the spouse was sent for military service;
  • monthly insurance payments for compulsory social insurance against accidents at work and occupational diseases;
  • income from the sale and rental (hire) of real estate (land plots, houses, apartments, dachas, garages), transport and other mechanical means, means of processing and storing products;
  • income from the sale of fruits and products of personal subsidiary plots (perennial crops, garden products, production and demonstration animals, poultry, fur-bearing animals, bees, fish);
  • Monetary allowances for military personnel;
  • Payment for work under the contract. Civil law;
  • financial assistance provided by employers to their employees, including former employees who quit due to retirement due to disability or age;
  • Royalties;
  • Business income;
  • Income from purchased shares, bonds, as well as income from interest on bank deposits;
  • Alimony;
  • Inherited and gifted funds.

In accordance with paragraph 2 of this resolution, one-time social assistance, both in cash and in kind, provided by government bodies in the prescribed manner and one-time insurance payments are not taken into account when calculating the average per capita income.
